These general terms and conditions govern the legal relationship between you as a guest and AG Hotel Dieschen.
The contract is concluded between the guest and Hotel Dieschen upon receipt of the written, telephone, electronic or
personal booking or via an internet-based booking system and the delivery of our confirmation. These General Terms and Conditions form an integral part of this contract.
If the booking guest registers further guests, he is liable for the fulfillment of their obligations.
The specific services provided by AG Hotel Dieschen are based on the reservation confirmation. If the guest requests services that are not provided by the hotel itself, the hotel acts merely as an intermediary. These services will be invoiced separately.
The prices are shown in the confirmation or the price list.
The hotel is entitled to request a deposit upon conclusion of the contract, primarily during the high season, for group reservations or special events.
In addition to a deposit, the hotel may also require a credit card guarantee and a signature. Credit card details are only used to secure the reservation. The final payment will be made on site after further consultation with the guest.
The deposit must be paid up to 30 days before arrival. This period may vary depending on the season. If the deposit is not paid on time, the hotel may terminate the contract after a short grace period of 5 days has elapsed without success and demand the cancellation costs specified under Clause 4.
The final bill must be paid at check-out in cash in Swiss francs or with an accepted debit or credit card (Maestro, Post, Master, Visa). In the event of overpayment of the services consumed, we are authorized to charge the entire amount to the credit card details on file.
Invoices from AG Hotel Dieschen are due for payment within 30 days of the invoice date without deduction.
Hotel Dieschen may change the advertised prices in the following cases:
4.1 General conditions
Changes and cancelations of bookings: Decisive for the calculation of a timely cancellation or change of a booking is the arrival of the written notification at the hotel, as well as the subsequent confirmation by the hotel.
Cancellations of internet-based bookings: Cancellations via internet-based booking systems are only legally effective if they have been canceled via the booking system in compliance with the cancellation conditions and accepted by the hotel.
If the customer cancels the contract, the following cancellation costs are payable according to Hotellerie Suisse, depending on the type of booking:
Packageand hotel bookings for individuals or groups
Cancellations up to 30 days before arrival: no cancellation costs
Cancellations 29 to 14 days before arrival: 50% of the total price
Cancellations 13 to 3 days before arrival: 60% of the total price
Cancellations 2 to 0 days before arrival: 80% of the total price
A deposit already paid will be refunded in all cases in the form of a voucher.
The rooms are available from 15.00 on the day of arrival. Rooms must be vacated by 11.00 a.m. on the day of departure. Late return of the rooms is only possible by prior arrangement.
The guest is not entitled to a specific room, unless otherwise agreed.
The rooms may only be used for the agreed purpose of overnight accommodation. The hotel is entitled to terminate the contract without notice if the contract has been concluded with false or misleading information or if the room is not used in accordance with the contract.
If the guest departs prematurely, Hotel Dieschen shall be entitled to demand the full agreed remuneration. Hotel Dieschen shall deduct what it has saved as a result of the non-utilization of its services or what it has received by renting the booked rooms to other parties. Savings shall only be deemed to exist if the accommodation establishment is fully booked at the time of non-utilization of the rooms ordered by the guest and the room can be rented to other guests due to the cancellation of the contracting party. The burden of proof of the savings shall be borne by the guest.
6.1 Malfunctions and operating restrictions
Disruptions (e.g. noise) or operating restrictions (e.g. defective sauna) do not entitle the customer to any compensation or refund.
Hotel Dieschen is only liable for damages in cases of intent or gross negligence. Liability for items brought in by the guest is excluded to the extent permitted by law. Claims must be made in writing to Hotel Dieschen immediately, at the latest 14 days after departure; otherwise the claims shall be deemed forfeited.
7.1. Haftung des Hotels
The hotel is liable for the property brought in by guests in accordance with the statutory provisions. No liability is accepted for slight negligence.
The Hotel shall not be liable under any legal title for services that it has merely arranged for the Guest (Section 3 (3)).
If the guest suffers damage or is not satisfied with the hotel’s services, he must notify the hotel immediately, otherwise he can no longer assert any rights. All claims against the hotel expire 6 months after the end of the contract.
Non-contractual liability shall be governed by the statutory provisions, subject to further limitations and exclusions of liability in accordance with these General Terms and Conditions.
The hotel room must be used and treated with the utmost care by the guest. It may only be used or occupied by the number of persons (including children) specified in the contract. The guest is not permitted to allow third parties to use hotel rooms rented from Hotel Dieschen. The guest shall be liable for any damage, unless he can prove that such damage was caused through no fault of his own or of other users. Damage must be reported to Hotel Dieschen immediately.
The hotel rooms are non-smoking rooms. However, if you smoke in the room or out of the window and the smell of smoking is detected in the room, a cleaning fee of at least CHF 250.00 will be charged.
Hotel Dieschen undertakes to comply with the applicable data protection legislation when handling and processing all customer data and customer usage data. Customer data will only be used to maximize operational safety or in the interests of sales promotion, product design, crime prevention, collection of key economic data and statistics and for invoicing. The guest hereby acknowledges and agrees that in cases of joint provision of services in cooperation with third parties, Hotel Dieschen is entitled to make customer data accessible to the third parties concerned to the extent that this is necessary in the interest of providing the services. Otherwise, the disclosure of customer data to third parties is only permitted with the express consent of the customer. An exception only applies if Hotel Dieschen is legally obliged to pass on personal data to third parties.
Reservation agreements, including general provisions and any additional agreements, as well as contracts concluded on the basis thereof, shall be governed exclusively by Swiss law. The exclusive place of jurisdiction for all disputes arising from these terms and conditions is Graubünden.
Changes to these general terms and conditions must be made in writing.
